Could Be Referred to Justice Department

In a new report, Sen. Ted Kennedy recommends that Secretary of Labor Elaine Chao refer Murray Energy, the mine where last year’s roof collapse ended up killing nine people, to the Department of Justice for prosecution:

“It is important to note that the mining operations proposed by Murray Energy, and approved by MSHA, at Crandall Canyon were among the most dangerous ever attempted.”

The report also describes Murray’s belligerent attitude about safety concerns. In an August 2006 email, Mining Safety and Health Administration district manager Allyn Davis wrote:

“Our relationship with Mr. Murray has been stormy thus far. That is also the pattern of his relationship with MSHA at his eastern mines. Just wanted to give you a heads up on that. He may not be a willing participant if he senses that anything you do could impact his ability to produce coal.”
